1. Introduction

LG Electronics Inc. and its family of companies (together, “LGE” or “we”) is committed to protecting the information of those individuals who use "Sites". This Privacy Policy sets out how we collect, use, and share information that we obtain as a result of your use of these services and, in particular, sets out:

• What information LGE may obtain from you as a result of your use of "Sites"
• How LGE uses the information that it obtains;
• When LGE shares information with others;
• When and why LGE may need to transfer your personal information
• How you may control LGE’s use and sharing of your information.

For the purposes of this Privacy Policy, the term "Software Solutions” is meant to apply to LGE’s software products, cloud services, or engineering services. Please know that the Software Solutions may contain software, services, devices and other functionality, which may be owned or controlled by third parties and not LGE and may be governed by separate privacy policies or practices. This policy is not meant to cover the practices of these third parties and only applies to products, services, devices and other technologies provided, manufactured or developed by LGE for you, as a user of the Sites.

In addition, LGE may provide links to other services owned and operated by third parties. These third party services are outside the scope of this Privacy Policy and have their own policies that apply to the collection, use, and sharing of information in connection with their services. We encourage you to read those policies. LGE is not responsible or liable for the privacy practices of such third parties.


2. What information does LGE obtain?

LGE collects and stores your information that you have provided to us. Here are some examples of manners in which we may collect your information on the Sites:

- We may ask you to be a member of LG Account to allow you to obtain access to the interactive elements (including the online forums) and business partner services of the Sites; LG Account enables you to use various services provided by LGE with one ID and password. When you first register with the LG Account, you will be asked and prompted to enter certain information, such as your email address (which will be your user ID), password, country of residence and date of birth. Depending on the LG Account Service you wish to use, you may need to enter certain information additionally such as your first and last name, zip/postal code, address, and telephone number;
- We may collect your first and last name, company name, job title, and email address if you request a marketing material (such as product brochure, white paper or other information) or if you contact us. It is entirely up to you whether you want to provide the information;
- We may collect your forum nickname if you create a forum profile, or otherwise log-on or use any portion of the Sites;
- We may collect your company name and company address if you request access to the business partner service of the Sites;
- We may collect details about any content, software or other applications that you download from the Sites;
- We may automatically log your IP address (the unique address which identifies your computer on the Internet) which is automatically recognized by our server when you use the Sites.


3. How will LGE use the information it obtains?

We use information obtained from the Sites (both non-personal information and, where applicable, personal information) for various purposes, including:

- To deliver information, content and other services to you;
- To contact you in response to the forms such as Contact Us or other inquiry.
- To provide access to the online forums;
- To alert you to special offers, updated information and other new products or services from LGE, or other third parties, or to forward promotional materials to you;
- To complete a transaction or service requested by you;
- To fulfill the terms of a promotion;
- To ensure the Sites is relevant to your needs;
- To help us create and publish content most relevant to you;
- To notify you about a material change to this privacy policy or the Terms of Use Agreement, if necessary; and

4. Information Sharing

We generally do not share with third parties the information we receive as a result of you using “Sites”. Nevertheless, please be aware of the following circumstances where we may share such information with third parties:

For example, if you upload or download content, software or applications from the Sites, we may share your personally identifiable information in order to fulfill your request. In addition, if you email us a question, we may use your email address to process your request and respond to your question. If you download a content, software or an application from the Sites, we may need to share your data with third parties in order to have that content, software or application delivered to you. Also, if you are entering a sweepstakes or contest, we may use your personally identifiable information in order to fulfill the terms of that promotion.
- To our parent company, subsidiaries and affiliates in order to better serve you. LGE may have to share your data with these parties in order to provide you with services that have been requested by you, or so that we can ensure our services and products are meeting your needs.
- To unaffiliated third-party service providers, agents or independent contractors who help us maintain the Sites and provide other administrative services to us (including, but not limited to, order processing and fulfillment, providing customer service, maintaining and analyzing data, sending customer communications on LGE’s behalf, and entry collection, winner selection and prize fulfillment for contests, sweepstakes and other promotions). We seek to ensure that these unaffiliated third parties will not use the personally identifiable information for any other purpose than to provide the administrative services for which they are responsible. Because such unaffiliated third-party service providers that help us administer the Sites will have access to users’ personally identifiable information, if you do not wish for our unaffiliated third-party service providers to have access to your information, please do not register or submit any personally identifiable information to us.
- To comply with the law or in the good faith belief that such action is necessary in order to conform to the requirements of law or comply with legal process served on us, protect and defend our rights or property, including the rights and property of LGE or act in urgent circumstances to protect the personal safety of our end users.
- To third parties as part of any corporate reorganization process including, but not limited to, mergers, acquisitions, and sales of all or substantially all of our assets.
- To track and analyze non-identifying and aggregate usage and volume statistical information from our visitors and customers and provide such information to third parties.
- To protect against potential fraud, we may verify with third parties the information collected from the Sites. In the course of such verification, we may receive personally identifiable information about you from such services.

 LGE will take commercially reasonable steps in order to ensure any such third parties treat your personal information securely.

Under no circumstances shall your personal information be processed for marketing purposes, nor shared with third parties for marketing purposes without your explicit consent.


5. Overseas Transfers
 
We, our affiliates, subsidiaries, and suppliers may use information (including your personal information) in countries other than where your devices are located in connection with providing you with our Services and any other purposes outlined in this Privacy Policy. The data protection laws in many of these countries may not offer the same level of protection as those in the country where you are located. However, before transferring your personal information we will take steps to ensure that such information will be afforded the same level of protection. By agreeing to this Privacy Policy you expressly consent to us and our business associates and suppliers processing your data in any jurisdiction, including, without limitation, Republic of Korea, in accordance with this Privacy Policy.

We use commercially reasonable efforts to safeguard the confidentiality of your personal information. Nevertheless, due to the design of the Internet, ever-changing technology, and other factors outside of our control, we cannot guarantee that communications between you and our servers will be free from unauthorized access by third parties or that we will not be subject to security breaches. We do not accept any responsibility for the disclosure of personal information due to errors in transmission or unauthorized or unlawful acts of third parties.


9. Protecting the Privacy of Children
 
Protecting the privacy of children is important to us. For that reason, none of our Services are directed at or designed to attract anyone under 14 years old. We also do not knowingly collect or maintain personal information from users who are under 14 years old. Should we learn or be notified that we have collected information from users under the age of 14, we will promptly delete such personal information.

If you are under 14, please do not attempt to register on the Sites or send us any Personal Information.


10. Changes to LGE's Privacy Policy

This Privacy Policy may be updated by LGE from time to time. If we make a material change to our Privacy Policy, we will update you via Sitess, or other means. If you do not consent to the updated privacy policy, some Services may be restricted.

For example, we may use your email address to confirm your request, to send you information about changes to our products and services, and to send notices and other disclosures as required by law. However, we provide you the opportunity to exercise an opt-out choice if you do not want to receive other types of communication from us, such as emails or updates from us regarding new services and products offered on the Sites or if you do not want us to share your personally identifiable information with third parties. If permitted by laws, a small fee for providing you with such service may be charged. Please note that we may decline to process your requests if they are unreasonably abusive, jeopardize the privacy of others, or are extremely impractical. In addition, you can access and modify some of the personal information you provided to us by logging into your account and changing the information that you previously provided.

From time to time, we communicate with users who use the Services through email.

6. How long will LGE keep my personal information?
 
We will take reasonable steps to make sure that we keep your personal information for as long as is necessary for us to provide you services or for the purpose for which it was collected, or as required by applicable law. We apply criteria to determine the appropriate retention period for different categories of personal information you provide us with. For example, we will keep information necessary to protect us in a legal claim, such as information relating to a contract, for the lifetime of the contract and up to seven years after. After this period it will be deleted or in some cases anonymised. Where we have collected the personal information based on your consent and we have no other lawful basis to continue with that processing, if you subsequently withdraw your consent then we will delete your personal information.

B. Internet and Other Network Activity. We collect information on your Internet and other network activity, including information about the way in which you interact with the Sites. C. Geolocation Data. When you register with the LG Account in order to obtain access to the business partner services, you will be asked to provide your address, zip/postal code or country of residence. We may also collect information about your company address, business region if you request access to the business partner service of the Sites. As a California resident, you have the right to “opt out,” or to direct us to stop selling or otherwise sharing your personal information with third parties in exchange for monetary or other valuable consideration.

H. Erasure for Users Under 18
California residents under the age of eighteen (18) who have registered to use the Sites and who have posted content or information on the Sites can request the removal of such information. To request removal of a submission, please send an email with a detailed description of the specific submission to caprivacy@lge.com. You also may be able to log in to your account and delete your own submission. LGE reserves the right to request that you provide information that will enable us to confirm that the Submission that you want removed was created and posted by you.
LGE will make a good faith effort to delete or remove your submission from public view as soon as reasonably practicable. Please note, however, that your request that we delete your submission does not ensure complete or comprehensive removal of your submission. Your submission may remain on backup media, cached or otherwise retained by LGE for administrative or legal purposes or your submission may remain publicly available if you or someone else has forwarded or re-posted your submission on another website or service prior to its deletion. LGE may be required by law to not remove or allow removal of your submission.

7. Third Party Websites
This Privacy Policy applies solely to information collected on the Sites. The Sites may contain links to other online platforms and websites that are operated by third parties. We do not control such other online platforms or websites and are not responsible for their privacy practices, content, or use of your information. LGE IS NOT RESPONSIBLE FOR THE PRIVACY OR SECURITY OF ANY INFORMATION YOU MAKE PUBLICLY AVAILABLE THROUGH THE POSTING OF UGC, NOR ARE WE RESPONSIBLE FOR WHAT OTHERS DO WITH THIS INFORMATION. WE ARE ALSO NOT RESPONSIBLE FOR THE ACCURACY, USE, OR MISUSE OF ANY UGC THAT YOU DISCLOSE OR RECEIVE FROM THIRD PARTIES THROUGH OUR FORUMS OR OTHER UGC FEATURES.

9. Overseas Transfers
As a global organization, we, our affiliates, subsidiaries, and suppliers may need to transfer your information outside the country where you registered for the services (for example, we may need to transfer information to our headquarters in South Korea). We may transfer your information in this manner in order to provide you with our software products and services, and for any other purposes outlined in this Privacy Policy, consistent with this Privacy Policy and any applicable laws. We make reasonable efforts to ensure security on our systems; however, no transmission of information over the Internet is guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you understand that any information that you transfer to LGE is done at your own risk.
If we learn of a security systems breach we may attempt to notify you electronically so that you can take appropriate protective steps. By using these Sites or providing information to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of these Sites. We may post a notice on our Sites if a security breach occurs. We may also send an email to you at the email address you have provided to us in these circumstances.
